Terms of Service

By accessing or using the NumsGo platform ("Service"), operated by NumsGo LLC ("Company," "we," "us," or "our"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not access or use the Service. Your continued use of the Service following the posting of any changes to these Terms constitutes acceptance of those changes.

These Terms constitute a legally binding agreement between you and NumsGo LLC. You represent that you are at least 18 years of age and have the legal capacity to enter into this agreement. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

NumsGo provides a platform for obtaining virtual phone numbers for SMS verification purposes. Our Service includes, but is not limited to:

• One-time SMS verification numbers for receiving verification codes from online platforms and services.
• Virtual number rental for extended-duration use, subject to availability and applicable fees.
• An API for programmatic access to SMS verification services for developers and businesses.
• A wallet-based payment system for purchasing and managing number usage.

The availability of phone numbers, countries, and supported services may vary and is subject to change at any time without prior notice. We do not guarantee the availability of any specific number, country, or service at any given time.

To use certain features of the Service, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information during the registration process.
• Maintain and promptly update your account information to keep it accurate and current.
• Maintain the security and confidentiality of your login credentials and not share them with any third party.
• Accept responsibility for all activities that occur under your account, whether or not authorized by you.
• Notify us immediately of any unauthorized use of your account or any other security breach.

We reserve the right to suspend or terminate accounts that contain inaccurate information, are used in violation of these Terms, or pose a security risk to the platform. You may not create multiple accounts for the purpose of abusing promotions, circumventing restrictions, or evading suspension.

The Service operates on a prepaid wallet-based system. By using the Service, you agree to the following payment terms:

• Deposits: You must add funds to your wallet balance before purchasing numbers or services. Deposits are processed through our supported payment providers and are subject to their respective terms and fees.
• Wallet Balance: Your wallet balance is a prepaid credit within the platform. It is non-transferable and may not be exchanged for cash except where required by applicable law.
• Pricing: Prices for numbers and services are displayed on the platform and may change at any time. The price at the time of purchase is the price you will be charged.
• Auto-Refund on Timeout: If a purchased number does not receive the expected SMS verification code within the designated timeout period, the purchase amount will be automatically refunded to your wallet balance. This is our standard policy and applies to all one-time verification purchases.
• Refunds: Wallet deposits are generally non-refundable. Refund requests for wallet deposits may be considered on a case-by-case basis at our sole discretion. We do not issue refunds for successfully delivered SMS messages or for numbers that received the requested verification code.
• Chargebacks: Filing a fraudulent chargeback or payment dispute will result in immediate account suspension and may result in legal action.

You agree to use the Service in a lawful, ethical, and responsible manner. The Service is intended for legitimate SMS verification purposes only. You agree not to use the Service for:

• Any fraudulent, deceptive, or misleading activities, including identity fraud or impersonation.
• Any activity that violates applicable local, state, national, or international laws or regulations.
• Sending unsolicited messages, spam, or bulk communications of any kind.
• Harassment, stalking, threatening, or abusing any individual or entity.
• Circumventing security measures, bans, or restrictions imposed by third-party platforms or services.
• Activities related to money laundering, terrorist financing, or other financial crimes.
• Creating fake accounts on third-party platforms for malicious purposes.

In addition to the restrictions outlined in the Acceptable Use Policy, the following activities are strictly prohibited:

• Attempting to reverse-engineer, decompile, disassemble, or otherwise derive the source code of the Service.
• Interfering with or disrupting the integrity or performance of the Service, its servers, or connected networks.
• Using automated tools, bots, scrapers, or crawlers to access the Service without prior written authorization.
• Reselling, sublicensing, or redistributing the Service or any numbers obtained through the Service without our express written consent.
• Exploiting any vulnerabilities, bugs, or errors in the Service for personal gain or to cause harm.
• Attempting to access accounts, data, or systems that do not belong to you.
• Circumventing any rate limits, usage restrictions, or access controls implemented by the Service.

Violation of these prohibitions may result in immediate account suspension or termination, forfeiture of wallet balance, and potential legal action.

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, images, software, code, APIs, and documentation, are the exclusive property of NumsGo LLC or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for its intended purpose, subject to these Terms. This license does not include the right to modify, reproduce, distribute, create derivative works from, publicly display, or commercially exploit any part of the Service without our prior written consent.

If you access the Service through our API, the following additional terms apply:

• API keys are confidential and must not be shared, published, or exposed in client-side code or public repositories.
• You must comply with all rate limits and usage quotas. Exceeding these limits may result in throttling or suspension of API access.
• We reserve the right to modify, deprecate, or discontinue API endpoints at any time. We will make reasonable efforts to provide advance notice of breaking changes.
• You are responsible for the security of your API integration and for any activity that occurs through your API key.
• API access is subject to the same Acceptable Use Policy and Prohibited Activities outlined in these Terms.
• We may monitor API usage to ensure compliance and to maintain the integrity and performance of the Service.

We strive to maintain high availability and reliability of the Service. However, the Service is provided on a "best effort" basis and we do not guarantee uninterrupted, error-free, or continuous operation. You acknowledge that:

• The Service may experience downtime for maintenance, updates, or unforeseen technical issues.
• SMS delivery depends on third-party carriers and providers over which we have no control. Delivery times and success rates may vary.
• Number availability is subject to inventory and third-party provider capacity.
• We do not guarantee that any specific number will successfully receive an SMS from any particular service or platform.
• We are not responsible for delays, failures, or errors caused by third-party services, network outages, or force majeure events.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NUMSGO LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We may suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice, including but not limited to the following circumstances:

• Violation of these Terms or any applicable law or regulation.
• Fraudulent, abusive, or suspicious activity on your account.
• Non-payment or chargeback of any amounts owed.
• Extended inactivity on your account.
• Request by law enforcement or government agencies.
• Discontinuation or material modification of the Service.

You may terminate your account at any time by contacting our support team. Upon termination, your right to use the Service will immediately cease. Any remaining wallet balance at the time of termination may be forfeited if the account was terminated due to a violation of these Terms.

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, store, and disclose your personal information. By using the Service, you consent to the practices described in our Privacy Policy. The Privacy Policy is incorporated into these Terms by reference. Please review our Privacy Policy for detailed information about our data practices.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Commercial Arbitration Rules. The arbitration shall take place in Dover, Delaware, and the arbitrator's decision shall be final and binding. Judgment on the award may be entered in any court of competent jurisdiction.

You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against NumsGo LLC.

We reserve the right to modify or update these Terms at any time at our sole discretion. When we make material changes, we will update the "Last updated" date at the top of this page and may notify you via email or through a prominent notice on the Service. Your continued use of the Service after any such changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.
